1. Agreement
These Terms of Use (“Terms”) govern your use of Green Screen Live Video Record, also referred to as Green Screen Live (the “App”), operated by Yohann Taieb (“we,” “us,” or “the operator”).
By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
2. The App
Green Screen Live is an iOS application for recording chroma-key (green screen) video. The App uses the camera and microphone to record, and the photo library to import media you select and to save recordings you choose to keep. Those permissions are requested by iOS and can be refused or revoked in Settings; features that need a permission will not work without it.
Optional features may include social accounts and a feed (which may use Firebase-style account and data services), in-app purchases and subscriptions processed by Apple, advertisements served by Google Mobile Ads, and push notifications delivered with OneSignal. Analytics tooling may be configured, and collection can be off. We collect what is needed to operate features you enable, as described in the Privacy Policy.
Availability of recording, the feed, purchases, ads, and notifications depends on your device, permissions, network, and the relevant third-party service.
3. Eligibility and accounts
You may use local recording without creating an account, subject to the permissions the device requires. If you create an account, post to the feed, or make a purchase, you must be old enough to do so under the laws of your country, or you must have a parent or guardian’s consent where that is required. The App is not directed to children under 13.
If you create an account, you are responsible for:
- Providing accurate account information.
- Keeping your sign-in credentials confidential.
- Activity that occurs under your account.
We may refuse, suspend, or close an account if we reasonably believe these Terms have been violated or if the service is being abused.
4. License to use the App
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to download and use the App on Apple devices you own or control, for your own personal, non-commercial use, except where a purchase expressly includes a broader right.
You may not:
- Copy, modify, or redistribute the App except as allowed by law.
- Circumvent security, access-control, or purchase checks, or attempt unauthorized access to the App or its services.
- Reverse-engineer the App except where applicable law allows it.
- Use the App to harm others, interfere with services, or overload the feed or notification systems.
- Use automated means to scrape, overload, or disrupt the App’s online features.
If you obtained the App from the Apple App Store, Apple’s Licensed Application End User License Agreement may also apply. If there is a conflict with Apple’s standard EULA on a topic Apple requires, Apple’s required terms control for that topic.
5. Your recordings and feed content
You keep ownership of videos, audio, photos, and other content you create or import with the App. Recording someone else, or using their image, voice, or work, may require their permission or another legal basis. You are responsible for having the rights you need.
If you post content to the optional feed or otherwise submit it to a feature we operate, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content only as needed to operate the feature you used (for example, to show a post to other users of the feed). This license ends when you delete the content or your account, except for copies already shared with other users, reasonable backup copies kept for a limited time, and uses we must retain for legal or safety reasons.
We may remove feed content or restrict an account if we reasonably believe the content violates these Terms or the law.
6. In-app purchases and subscriptions
The App may offer in-app purchases or auto-renewable subscriptions. Prices, duration, and what a purchase unlocks are shown in the App at the time you buy. Payment is charged to your Apple ID by Apple. We do not receive your full payment card number.
If a subscription renews automatically, Apple charges your Apple ID at the start of each renewal period unless you cancel at least 24 hours before the period ends. You can manage or cancel a subscription in your App Store account settings. Deleting the App does not cancel a subscription.
Refunds are handled by Apple under Apple’s policies. To the extent allowed by law and by Apple’s rules, purchases are otherwise final. We may change what a paid feature includes going forward, or stop offering a product, but we will not take away a purchase you already paid for during the period you paid for, except where we must (for example, for abuse or legal reasons) or where Apple refunds the purchase.
7. Advertising
The App includes Google Mobile Ads and may display advertisements. Ads can be based on context or, where you allow it under Apple’s tracking settings, on advertising identifiers. We do not sell your personal data. Google’s terms and privacy policy apply to ad delivery.
8. Push notifications
If you allow notifications, we may send messages about the App through OneSignal and Apple Push Notification service. You can turn notifications off in iOS Settings at any time. Notification delivery is not guaranteed.
9. Acceptable use
You agree not to use the App to:
- Record, share, or post content that is unlawful, or that infringes someone else’s copyright, trademark, privacy, or publicity rights.
- Harass, threaten, or impersonate others, including in the feed.
- Post sexual content involving minors, or any other content that is illegal to possess or share.
- Interfere with the App, other users, or the services that support accounts, ads, purchases, or notifications.
- Misrepresent your identity in a way that deceives other users.
We may remove content or restrict access as we reasonably consider necessary to enforce these Terms or protect users.
10. Intellectual property
The App’s name, branding, and the operator’s rights in the distributed App are reserved, except for rights granted to you under these Terms. You do not acquire ownership of the App by using it. Your recordings and posts remain yours, subject to the license in section 5.
Feedback you send us (for example, via GitHub Issues) may be used to improve the App without obligation to you.
11. Privacy
Our collection and use of personal data is described in the Privacy Policy. We collect what is needed to operate features you enable. We do not sell personal data.
12. Third-party services
The App relies on third parties to provide some features, including Apple (distribution, payments, and push delivery), Google Mobile Ads, OneSignal, and Firebase-style account or feed services when you use those features. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.
If you contact us on GitHub, GitHub’s terms apply to that site. App Store distribution is also subject to Apple’s terms between you and Apple.
13. Disclaimer of warranties
The App and its online features are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that recordings, the feed, ads, purchases, or notifications will always be available or accurate. Chroma-key results depend on lighting, the background, and your device.
Some jurisdictions do not allow certain warranty disclaimers. In those places, the disclaimer applies only to the extent permitted.
14. Limitation of liability
To the fullest extent permitted by law, the operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost recordings, or lost goodwill, arising from your use of the App.
To the fullest extent permitted by law, our total liability for any claim arising out of the App is limited to the amount you paid to us for the App or in-app purchases in the twelve (12) months before the claim, or USD $10 if you paid us nothing.
Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud, where such a limit is not allowed).
15. Termination
You may stop using the App at any time by uninstalling it and, if you wish, requesting deletion of an optional account. Uninstalling does not by itself cancel an Apple subscription. We may suspend or stop providing all or part of the App, including the feed, at any time.
Sections that by their nature should survive (including your content license for content already shared, intellectual property, disclaimers, and limitation of liability) will survive termination.
16. Changes
We may update these Terms. The date at the top of this page will change when we do. If you continue to use the App after the updated Terms are posted, you are expected to review them. If you do not agree, stop using the App.
17. General
If a provision of these Terms is found unenforceable, the remaining provisions will still apply. These Terms are the entire agreement between you and us regarding the App, except for Apple’s required App Store terms where applicable.
These Terms are a draft and do not create any partnership or employment relationship.
